This month we look at four recent sentencings under the Health and Safety at Work Act. The first resulted after a worker suffered burns when a forklift caught fire and ignited condemned LPG cylinders, causing an explosion. The other three were brought by Maritime New Zealand for different incidents involving the same large seafood company. We also cover the first reading of the Health and Safety at Work Amendment Bill, which is the first proposal for substantive reform of New Zealand’s work health and safety law since the Act was passed in 2015.

Falls from height remain a leading cause of death and injury for workers. In this month’s issue, we look at two recent convictions of companies on each side of the Tasman after a worker died and another sustained devastating injuries. We also cover the new “Statement of Intent” from WorkSafe which signals a greater emphasis on education and engagement with businesses, and more enforceable undertakings in place of prosecutions. Finally, we have articles on Victoria, Australia’s new regulations to make psychological health a priority for employers, and Auckland Council’s latest prosecutions under the Resource Management Act. This month, we look at the latest enforceable undertaking accepted by WorkSafe after a Kura endangered the safety of a group of students who went on a river float activity down the Waikato River using pool toys and noodles. We also have an article about a 2019 crash between a van and an off-road logging truck on a private forestry road that killed four workers and the Coroner’s unusual decision to refer the case back to WorkSafe to investigate under the Health and Safety at Work Act. In addition, we cover a massive AU$1.43 million fine imposed on a company and its director for failing to manage workplace fatigue after a delivery worker died in a road crash. Finally, and following the severe October gales, we briefly touch on guidance for the construction industry on preparing for the hazards of high winds.
