The Safe Side | Issue 72
13/10/2025
Last year, New Zealand’s poor safety performance cost the country $5.4 billion according to a new report by economist Shamubeel Eaqub for the Business Leaders’ Health and Safety Forum. In this issue, we look at some of the key findings from the Forum’s report. We also have articles about the recent sentencing of a scaffolding company after a nine-metre-high scaffold fell on a busy road in Auckland; and the tragic death of a 16-year-old Queenslander while gaining work experience. Finally, we briefly cover the just published “Approved code of practice: Safe practice for forestry and harvesting operations” which aims to increase the safety of workers in New Zealand’s most deadly industry.

We sometimes report on the prosecution of forestry companies for health and safety offences, but the sector’s potential statutory liability exposures do not end there. In this issue, we look at several recent prosecutions by the Waikato Regional Council for environmental failures by forest harvesting companies. We also cover the updated guidance on managing the risks of leptospirosis infection from WorkSafe; and an appeal that was dismissed in the High Court, confirming the earlier conviction of a health and safety consultancy company for failing to provide a traffic management plan that it had undertaken to supply. Finally, we have an article about an eye-watering £3 million fine handed down to British Airways after two workers fell from height while unloading baggage from aircraft at Heathrow Airport.

In this issue, we look at the second sentencing this year following the death of a worker in a running conveyor belt. In this case, both the company and its director were charged and convicted. We also cover the filing of new charges against KiwiRail – this time for the grounding of the Interislander ferry Aratere just north of Picton last year. In addition, we have an article about two workers who were overcome by hydrogen sulphide gas when working at a West Coast construction and demolition waste facility. Finally, we look at an Australian prosecution that came about after the tragic death of an electrical apprentice who was electrocuted while working in his father’s company.
